General Terms andConditions
These terms apply to all contracts between Agron Ademi (hereinafter the Provider) and his clients (hereinafter the Client).
1. Scope
These terms apply to the planning, design, development and maintenance of websites and web applications, as well as to all related services.
Deviating terms of the Client apply only if the Provider has confirmed them in writing.
2. Quote and contract
Quotes are valid for 30 days. The contract is concluded when the Client confirms the quote in writing or by email.
The scope of services is determined by the quote. Additional requests are quoted and invoiced separately.
3. Prices and payment
All prices are stated in Swiss francs (CHF).
A deposit of 50 percent is due upon placement of the order. The balance is due upon acceptance or before publication.
Invoices are payable within 30 days. In the event of late payment, the Provider may suspend work until all outstanding amounts have been paid.
4. Cooperation of the Client
The Client provides texts, images, logos and other content in good time and in a usable form.
The Client confirms that they hold the rights to all content supplied and indemnifies the Provider against any claims by third parties.
Delays caused by missing content postpone the schedule accordingly.
5. Revisions
The number of revision rounds is specified in the quote. Further changes are invoiced according to time spent.
6. Acceptance
Upon completion, the Client reviews the website within 10 days. If the Client reports no defects within this period, the website is deemed accepted. In any event, it is deemed accepted upon publication.
7. Rights of use
Upon full payment, the Client is granted the right to use the website for the agreed purpose without time limitation.
The Provider may present the project as a reference on his website and in his materials, unless the Client objects in writing.
8. Hosting and third parties
Domain, hosting and licences for plugins or fonts are held by the Client, unless otherwise agreed. The Provider accepts no liability for outages or changes made by external providers.
9. Warranty and liability
The Provider rectifies, free of charge, any defects reported within 30 days of acceptance.
Liability is limited to damage caused intentionally or through gross negligence. To the extent permitted by law, the Provider accepts no liability for loss of profit or loss of data.
10. Maintenance
Maintenance contracts may be terminated each month, effective at the end of the following month. The scope is set out in the respective agreement.
11. Final provisions
Swiss law applies exclusively. The place of jurisdiction is the registered office of the Provider.
Should any provision be invalid, the remaining provisions shall remain valid.
